Business Purpose

Kivora Digital S.L. is a company dedicated to providing services in the field of information technology, including, but not limited to:

• Information and communication technology (ICT) consulting services.
• Development, design, implementation, and marketing of custom software.
• Creation of computer applications and website design.
• Software maintenance, support, and updates.
• Publication of applications on digital platforms.
• Advice, installation, and maintenance of computer systems.

Access and Use Conditions

Access to and use of the Platform confers the status of user, who undertakes to use the services and content in accordance with current legislation, good faith, and public order.

To access the services, the user must meet the following requirements:

• Be of legal age or, if a minor, have the authorization of parents or legal guardians.
• Have the legal capacity to contract.
• Provide truthful, accurate, and updated information when requested.
• Accept these Terms and Conditions and the Privacy Policy.
• Use the Platform in accordance with current legislation, morality, good customs, and public order.

Services Offered

Through the Platform, Kivora Digital offers the following services:

• Design and development of websites and applications.
• Technology consulting.
• Maintenance services and technical support.

• Digital marketing and communication services.

The specific conditions of each service (scope, deadlines, etc.) will be detailed in the corresponding commercial proposal or contract.

Pricing and Billing

The prices of the services will be those established in the commercial proposal accepted by the client. We reserve the right to modify prices, notifying the client in advance.

All prices are shown exclusive of applicable taxes (such as VAT), which will be added to the final invoice.

Payments will be made according to the agreed conditions (bank transfer, direct debit, etc.) within the stipulated deadlines.

Intellectual and Industrial Property

Kivora Digital S.L. is the owner of all intellectual and industrial property rights of the Platform and its content (texts, images, software, etc.). The source code of the custom software is the property of Kivora Digital, unless otherwise agreed.

The client will own the exploitation rights of the final product upon full payment of the service, as stipulated in the contract.

Responsibilities

Of Kivora Digital

We commit to:

• Provide contracted services according to agreed conditions.
• Maintain the confidentiality of information provided by the client.
• Implement appropriate security measures to protect data and systems.
• Ensure, to the extent reasonably possible, the availability and security of the Platform.
• Inform with sufficient advance notice about any scheduled service interruption for maintenance tasks.
• Make the necessary changes to third-party services to ensure the proper delivery of our services. We are not responsible for interruptions or failures derived from such external services.
• Comply with applicable legislation regarding data protection and information society services.

Of the User

The user agrees to:

• Use the Platform and services in accordance with law, morality, good customs, and public order.
• Not use the Platform or services for illegal activities or that may cause harm to third parties.
• Provide truthful and accurate information when requested.
• Not attempt to access, modify, manipulate, or damage Kivora Digital's systems, equipment, or content.
• Exempt Kivora Digital from any liability arising from the user's failure to comply with these terms.
• Respect intellectual and industrial property rights.
• Maintain the confidentiality of access credentials.
• Have the systems and equipment necessary to connect to the Platform.

Limitations of Liability

Kivora Digital will not be liable for:

• Interruptions in the operation of the Platform due to force majeure or circumstances beyond our reasonable control.
• Technical problems or system failures not directly attributable to Kivora Digital.
• Content or services provided by third parties through our Platform.
• Improper use of the Platform or services by users.
• The accuracy, exhaustiveness, or timeliness of content, information, and third-party offers published on the Platform.
• Decisions that the user may make based on the information offered on the Platform, which is provided for informational purposes only.
• Indirect damages, lost profits, or business losses arising from the use of the Platform.

Modifications to the Terms

We reserve the right to modify these terms at any time. The modifications will be effective upon their publication on the website.

Termination

We may suspend or terminate access to our services if the user breaches these terms. The user can cancel their account at any time.

Applicable Law and Jurisdiction

These terms are governed by Spanish law. In case of dispute, the parties submit to the Courts and Tribunals of the domicile of the website owner, or where applicable, to those corresponding according to consumer protection regulations.

Entire Agreement

These terms constitute the entire agreement between the user and Kivora Digital S.L. in relation to the use of the Platform.
